Soda/Pop & How Intoxicants are Haraam
QUESTION:
On the question of soft drinks containing alcohol, some Ulama are of the view that alcohol which is not grape extract is permissible. The Ulama who hold this view contend that:
• If the alcohol is neither from dates nor grapes it is permissible.
• Imaam Muhammad’s view of prohibition does not apply to soft drinks because the factors found in intoxicants are not in soft drinks.
The claim that non-grape and non-date alcohols are permissible has come as a great surprise to many who have read the fatwa issued by the Ulama who hold that soft drinks are permissible. The categoric fatwa proclaiming non-grape and non-date alcohol permissible has far reaching consequences and repercussions which I as a layman can foresee. Whiskey, vodka, champagne, all beers and most varieties of wines and liquors contain ethanol or non-grape and non-date alcohol. on the basis of the fatwa of permissibility of ethanol, it follows that all forms of wines if taken in small quantities which do not intoxicate will be permissible. Please comment and clarify the confusion caused by this fatwa of permissibility of ethanol.
ANSWER:
RASULULLAH (SALLALLAHU ALAYHI WASALLAM) said that as Qiyaamah draws near, liquor will be made lawful by dubbing it with fancy names. The initial stage for such legalization of liquor has already commenced. And this process, sad to say, has been initiated by the Ulama of this time. Whereas in former times Ulama closed the slightest avenue from which haraam and corruption could enter, in these times in proximity to Qiyaamah, some Ulama have adopted a diametrically opposite stand. Instead of closing avenues of haraam and corruption, they not only open such avenues, but actively foster and defend such processes which constitute the introductory steps to haraam.
Every Muslim with a little intelligence will understand the purport of the following Hadith: “Every intoxicant is haraam.” And, every clear-thinking Muslim who has no vested interest or axe to grind or who has no allegiance to an organization other that the Shariah or who is unbiased will readily understand the meaning of the following Hadith: “Whatever of a great quantity intoxicates, a lesser quantity of that substance is (also) haraam.”
Ethanol (the non-grape and non-date alcohol) is the intoxicating agent in all liquors which contain this substance. Take away the alcohol, and the whiskey, champagne, etc. will cease to be liquor. All contain ethanol. All these drinks have been converted into wine/liquor by ethanol. on the basis of the ‘fatwa’ of permissibility it will follow that a few drops of whiskey added to a glass of water or any other lawful drink will not render that drink haraam because the whiskey contains ethanol, not grape alcohol and not date alcohol.
Some beers contain the same minute percentage of ethanol alcohol as soft drinks, yet thus far none of those who say ethanol is permissible has ventured to say that beer is halaal although that time is not far off when beer and wines will be openly declared ‘halaal’ based o¬n the ethanol permissibility fatwa. If a few drops of beer or vodka or whisky will render water or any syrup or drink haraam, there is no logical reason for claiming that any drink besides known beers, which contain ethyl alcohol is halaal. By the same token if a soft drink with a small quantity of ethyl alcohol can be halaal then a beer with a small quantity of ethyl alcohol will also be halaal. The issue is not whether soft drinks intoxicate or not. Beer like Barbican and others do not intoxicate and cannot intoxicate o¬n account of the minute quantity of ethanol it contains. Regardless of the quantity, intoxicants are haraam. Whether the intoxicant is in beer or soft drinks (Barbican too is a soft drink) it is haraam and will render the drink haraam.
The claim regarding Imaam Muhammad (rahmatullah alayh) is very misleading. The illustrious Hanafi Fuqahaa of the past 13 centuries were all aware of all the arguments of Imaam Abu Hanifa, Imaam Abu Yusuf and Imaam Muhammad (rahmatullah alayhim). Inspite of their thorough knowledge of the arguments of these Fuqahaa, the fatwa of the Hanafi Math-hab for the past 13 hundred years has been on the ruling of Imaam Muhammad (rahmatullah alayh). Why do these Ulama in this belated age seek to override the Fatwa or the 13 century old Fatwa of the Hanafi Math-hab for the sake of Coke? And, in the process of trying to abrogate this Fatwa they are opening a wide door of fitnah and corruption by providing ‘proofs’ for the permissibility of alcohol – liquor and beer.
The Fatwa of the Hanafi Math-hab remains valid and in full force even today and so it will remain until the end of earthly time. No o¬ne has the authority to override this 13 hundred year old Fatwa by attempting to water it down with the assertion that it is Imaam Muhammad’s ruling/view in conflict with the view of Imaam Abu Hanifah. People of Ilm should understand the operation of the principles of the Math-hab. They should not attempt to detract from the gravity and importance of the Fatwa of the hurmat (prohibition) of all types of alcohol by simply attributing the prohibition to Imaam Muhammad (rahmatullah alayh). In so doing they are rendering a great disservice to the Deen and are unconsciously constituting the category of men who come within the scope of the Hadith which predicts the legalization of liquor.
It should be noted that the scope for the permissibility of using non-grape and non-date alcohol applies to medicines and non-edibles. In view of the difference of opinion among the Fuqahaa regarding the types of alcohol, the latitude in its use is restricted to essentials. The permissibility cannot be extended to non-essential consumables which in fact are harmful for the health. There is thus no scope whatever for proclaiming soft drinks permissible o¬n the basis of the ikhtilaaf (difference) of opinion. It is indeed the height of folly, to say the least, to upset the Fatwa of the Hanafi Math-hab, viz. Imaam Muhammand’s view for a physically ruinous substance such as coke. It is extremely irresponsible to reject the 13 century Fatwa of the Hanafi Math-hab and open a wide doorway for future ‘legalization’ of liquor purely for the sake of consuming a drinks which wrecks the physical health. o¬ne small bottle of soft drink contains 12 teaspoons of sugar. Wisdom and responsibility demand that in so far as coke and soft drinks in general are concerned, o¬nly the view of Imaam Muhammad be entertained.

Dear Shaikh As-Salaamu alaikum wa-Rahmatullah
Hoping you are well.
I feel compelled to bring to your notice that having heard the representatives of SANHA and MJC at the meeting on Saturday (24th of August 2002) in Cape Town, I come to the following conclusions:
1.) Although, as mentioned by your chairman, the evidence was not tested, it was clear as daylight sun that gross discrepancies had been discovered by SANHA at some of the plants and companies certified by the MJC.
2.) When these serious grievances were brought to the attention of your Halaal Trust, much of it was totally ignored. SANHA provided documentary evidence, in a very comprehensive report, tabled at the meeting. The response to other letters was either, a threat of action against SANHA or some justification for the error.
3.) To any person studying the report or listening with an open, unbiased, unprejudiced mind, to the representatives of SANHA and MJC at the Hearing, the following would emerge:
(a.) The only complaint of MJC Halaal Trust seems to have been the unethical, un-Islamic practice of SANHA’s “interference” in its certification.
(b.) SANHA considering “Shaafi” Mazhab as inferior.
(c.) SANHA considering MJC’s standards as inferior.
I have had an excellent working relationship with MJC for decades. We have always co-operated on many projects and respected each others views and differences on matters, as long as they were based on the Qur’aan and Sunnah. The Jamiat always considered MJC as a Halaal Certifying body and accepted its certified products. Nay, even consumed some of them over the years.
So it is not a question of “prejudice” that I state the following:
Almost everyone that was present there, including some MJC members, whom I contacted later, agreed that there were serious flaws and major discrepancies that had to be addressed; as a matter of urgency. .
That the myth that it was a “Hanafi / Shaafi ” issue was not true.
That SANHA was not witch-hunting but merely informing the public of their findings, when MJC fails to respond to their queries and complaints.
Wallah, my stomach churned and heart seemed to skip a beat when I read the comprehensive report submitted by SANHA. I honestly believe and share the tears of Shaikh Omar Khabir at the meeting that a great injustice has been done to the Ummah. Amongst many other discrepancies, the following were recorded:
Well documented evidence was presented of severing just one vein (rendering chicken totally Haraam according to all Mazhabs). .
Products containing pork fat, blood plasma, white wine flavour, bacon flavour, blood powder, etc. were marketed with the MJC label. .
Confirmed slaughtering by non-Muslim slaughterers.
Non-Muslim inspector and staff. .
Contamination in fridges of Halaal and Haraam items. .
Non-Muslim wholesaler with no Muslim staff, supplying MJC certified Halaal meat. .
Haraam or absolutely doubtful imports from Brazil, China, etc., certified Halaal and the list goes on.
I repent, that although the evidence was not tested, I, for o¬ne, am certain that if it had been arbitration, more shocking disclosures would have surfaced.
I am always one for conciliation and settlement of disputes. However having read the report and listened carefully to both sides I am of the opinion that if the discrepancies had not been brought to the attention of the MJC, it would have been “un-Islamic and unethical “.
My concern now is that just concluding with a working committee is not enough. When the report was read by members of the Jamiat Natal, they were shocked beyond belief that for monetary gain, the MJC Halaal Trust could have allowed so much of Haraam to be consumed by innocent Muslims. It makes us shudder on how we will answer Allah Ta’ala, when all those who consumed Haraam on our guarantee that it was Halaal, will catch our garments on the Day of Qiyaamah. May Allah Ta’ala protect us from His Azaab.
My suggestion is that the MJC should immediately look at all its certified plants and companies:
Implement the most stringent standards.
That it should allow the take over of operations outside the Cape Province by SANHA or Regional bodies. The MJC cannot do justice to National and International certification. .
The MJC should work in co-operation with SANHA towards a national certifying body. Monetary gain or commercial interests should never be the criteria of Ulama bodies. .
A senior member of MJC stated openly at a meeting: “We need the money. We run our projects with it. .”
If the MJC is unable to maintain and control standards at certain plants, then it must withdraw its Halaal certificate and announce this in the Press. It should never, never, allow, at any cost, Haraam and doubtful products to be consumed.
The comprehensive report should not be shelved away. It should be studied by all MJC Halaal Trust members. Thousands of Rands and valuable man hours must have gone in its preparation.
I do agree that there could be aspects of it which could be “rebutted” as Shaikh Yaaseen mentioned. However, even if just 20% of it is true, it is cause for major concern.
I, for one, who used to openly declare all products certified by MJC as Halaal for many years and even consume some at times, am truly and deeply disturbed.
How can I guarantee them anymore?
Please forgive me for this letter. My conscience weighed heavily on me.
Do read the letter with an open mind and in its right context. We are all human. No one or no organization is perfect. We must have the humility to acknowledge and accept our mistakes, and rectify.
The MJC has kept Islam alive in the Cape through its Imaams and projects. May Allah Ta’ala strengthen it and may it continue to serve the community at large, with sincerity.

ARE LOCALLY SLAUGHTERED CHICKENS IN SAUDI ARABIA HALAAL
Q. We are a group proceeding to Saudi Arabia. We intend spending 3 months. We have heard much about the haraam meat and chickens in Middle Eastern countries. Are locally slaughtered chickens in Saudi Arabia halaal?
A. Even the local chickens in Saudi Arabia, which are slaughtered commercially, i.e. the broiler chickens, should be avoided. The same haraam Sanha methods are used to torture and kill the chickens. The safest is to abstain totally from meat and chicken when in Saudi Arabia. There are numerous varieties of vegetables and grain foods. Fish, eggs, bread, etc. There are many Pakistani restaurants where vegetable diet is available. It will do you good to abstain from meat for a couple of months. After all, Insaan is not a carnivorous animal. He should exercise some restraint on his nafs, and abstain from Haraam and Mushtabah food.
Nowadays, people no longer understand the meaning of Haraam and Mushtabah. SANHA and MJC type ‘halaal’ carrion has ruined the Imaan of millions of people. MJCSANHA Haraam carrion has corrupted and darkened the hearts and souls so much that even if Muslims knowingly devour MJC-SANHA approved pork, they will not be able to differentiate between the carrion chickens and halaalized pork.
Maulana Yunus Patel Sahib, who is a senior Durban Molvi, has whined and lamented much when SANHA had exposed the MJC’s carrion halaalization industry. The respected Maulana Saheb is not a controversial person like The Majlis. However, despite the fact that he proclaimed MJC carrion products to be haraam according to all Four Math-habs and that even pork and blood had been halaalized, molvis and sheikhs continue relishing and defending MJC carrion products. They are used to devouring carrion, and since they are unable to kick the addiction, they feel compelled to defend the ‘halaal’ status of the diseased, rotten, haraam carrion.
The MJC, SANHA and all the supporting molvis and sheikhs with their carrion halaalization industry have transformed Muslims into carnivorous beasts who relish on diseased, rotting carrion. Can anyone then wonder why Hadhrat Maulana Yunus Patel Sahib lamented: “My stomach churned and my heart skipped a beat”? It was SANHA’s Secret 223-Page Document exposing MJC Carrion which constrained the churning of the stomach and the skipping of heart beats.

At the outset our guiding principles must be based on the Shariah. At this stage the issue of Genetic Modification is highly nebulous and no definite decision can be given based on the sparse and indefinite nature of the facts available.
On the one hand, some would advocate that the process is in itself Haraam because of the Qurânic prohibition of tampering with the creation of Allah:
"I shall mislead them, and I shall create in them false desires; I will order them to slit the ears of cattle, and to deface the (fair) nature created by Allah, Whoever, forsaking Allah, takes Satan for a friend, hath of a surety suffered a loss that is manifest". [an-Nisa:119]
An issue then of the product itself being Haraam is separate from whether the process is permitted or not. On the other hand, grafting of one tree onto another was practiced and permitted during the lifetime of Rasulullâh sallallâhu alayhi wa sallam.
It cannot be said with definite certainty at this stage in which of the two (if either) GM falls in. The next guiding principle would be whether GM is harmful or beneficial to mankind. Again, the pro and anti camps swear to the truth of their respective causes, but at present, the debate continues. None can thus say with certainty whether GM harms or benefits.
What is certain is that a great doubt exists in various aspects, such as the health implications, environmental impact, political agenda of the GM companies etc.
In light of the above facts SANHA does not promote GM foods.
In regards to certification of GM products, our policy is:
- Plant with plant modification is allowed.
- Plant on animal modification is allowed.
- Animal on plant and animal on animal is not allowed.

Dining where Alcohol is served
We refer to the article in the Sunday times of 8/12/08 entitled "Halaal watchdog warns Muslim diners against 'forbidden' eateries"
There are several inaccuracies in the statement made on behalf of the National Halaal forum by their spokesperson and attorney for the Muslim Judicial Council, Mr. Zaahir Williams.
He states that "it was ultimately left to Muslim consumers to decide 'whether its permissible to eat at a certain place'" is inaccurate particularly where there is a flagrant violation of the Shariah e.g. a bar, night club etc. Determining permissibility and impermissibility is not the prerogative of the Muslim consumer. The legality and illegality of any aspect is enshrined within the Shariah (Islamic Law). Indeed, the prerogative to abide by the law or not lies with the individual.
In respect of his statement that "a lot of Muslims are comfortable to sit in a restaurant where there is a certificate that assures them that the food is halaal, but somewhere in the corner if the establishment there is a small bar for those non Muslim customers who enjoy a glass of wine", none of the National Halaal forum members viz NIHT (National Independent Halaal Trust),MJC( Muslim Judicial Council) and ICSA ( Islamic Council of South Africa), to our knowledge grant certification to outlets who serve alcohol. Is there a change in this consensus policy?
The spokesperson's statement is at odds with the MJC's position as stated by their public relations officer on air where she stated "I would like to categorically state that the MJC has not and will not in future certify any restaurant that sells alcohol."
Finally, whilst we always welcome more Halaal operated outlets, we are of the opinion that there is more that the "little choice" available to the Muslim consumer as alluded to by the spokesperson. Perhaps this incorrect perception is being perpetuated by the paucity of information and reluctance by certifiers to publish comprehensive listings of all certified outlets.

Kindly confer with with any reputable Darul Iftâ for further elaboration and assistance in this regard.Snail extract – The water soluble part of the Snail is mainly responsible for its flavour and extracted properties. The Snail flesh is immersed in boiling water to leach out and concentrate the water soluble extractives. This is how such extract is derived.

Answer
Brine injecting is widely practised and permitted. In essence, brine solution comprises of salt water and flavour. The salt in the solution causes the cells in the meat to open thus facilitating osmosis, and exchange of fluids. This results in much more moist and flavourful meat.Brine injecting of poultry is absolutely safe for human consumption.
Legislation controls the amount of brine which may be injected. This may differ from country to country.

Shellac is a secretion of the lac insect which is related to the scale insects of the coccodea family. It is native to India and Mexico.Whilst Shellac is generally defined as a secretion of the lac insect, our investigations have revealed that Shellac does not only comprise of the secretion but also insect residue which cannot be avoided and thus forms part of the ingredient.
SANHA has researched, and consulted with various Muftīs on the issue of Shellac for almost two years and exhausted every possible angle on this issue. The Muftīs are unanimous that Shellac is not permitted for consumption.

Sauces Halal / Haram?
Sauces are one of the most versatile innovations in man's love affair with food.
Very few foods indeed are eaten without some kind of sauce, be it a tomato sauce with a burger, as soya sauce with stir fry, chutney and relishes with chicken tikka and kebaabs, a base or topping sauce of a pizza, a basting sauce or marinade for a braai, mayonnaise and vinegar as salad dressing and caramel sauce for dessert.
The function of a sauce is to enhance flavour and act as a binder or thickener to prevent separation and increase the appeal of the dish. Its versatility makes it a firm favourite with cooks as it is available in powder, paste and liquid; in thick, medium or thin textures. It can be cooked separately or utilized as a cook-in-sauce.
More than three thousand substances are intentionally added to foods and drinks to produce a desirable effect.
Oil, egg, butter, milk, alcohols such as brandy, white wine, cognac etc. vinegar, starches, gelatin, food colouring, flavouring, spices, preservatives and in certain instances even blood, can be used in the making of sauce.
Current labelling laws do not adequately disclose all ingredients in products. Take a tour of your kitchen and observe the ambiguity of the labels on various products.
Eating out at restaurants is even more of a gamble as there isn't even a vague label to allay our apprehensions. Who would have thought that an onion and mushroom sauce can contain white wine and veal stock, a honey and lemon sauce or a herb and egg sauce can contain chicken stock or a hot chocolate sauce can contain rum.
These examples are but a reminder of the compelling need for Halal bona fide certification.

We have been liasing with Krispy Crème UK, and according to the information we have received:
As a general rule,Krispy Crème (UK) Doughnuts are permissible.
However just recently they brought a new line out which contains marshmallows.
Krisp Kreme - rocky road contain pork gelatine in their marshmallows
ALWAYS check ingredients.
Please do note that they use alcoholic flavourings.

How reliable is Ifanca??
In November 2000, Mohammed Mazhar Husseini, co-founder and former executive director of Islamic Food and Nutrition Council of America (IFANCA), a major halal certifying body in North America that is widely accepted as providing quality certification by many Muslim countries including Saudi Arabia, officially put in his resignation to the organization that he helped create nearly 30 years ago.
“They (IFANCA) are interested in charging fees and certifying products (as halal) and getting commission,” he said in an interview with Sound Vision, an Islamic information website.
Husseini noted that in earlier years the organization was more education-oriented and community based in offering workshops and organizing seminars on Halal food issues, something that no longer takes place. Offering more insight into the practices creating problems in the halal food industry, a book published in 2003 by Mian Riaz and Muhammad Chaudry, entitled “Halal Food Production,” agrees that a number of the products that international companies are marketing as Halal are not as permissible as one might think
